‘My Favourite Charity’ Terms and Conditions
1) Entry Period:
The ‘My Favourite Charity’ competition (the “Competition”) begins on 1st October 2016 at 00:00:01 UK time and ends on 31st October 2016 at 23:59:59 UK (the “Competition Period').
For eBay users
The Competition is open to UK residents who are 18 years of age or over, registered members of www.eBay.co.uk at the time of entry and whose eBay account (on any site) is in good standing (see paragraph 8 for details) (“Eligible Participants”). Employees (and their families) of eBay, affiliates, subsidiary companies, representatives or agents of those companies, or Wire Stone, Inc. and anyone else who may be directly involved with the Competition in a professional capacity are ineligible for the Prizes or the Awards.
Please note you must have a valid PayPal account to be eligible to receive a prize.For charities
The Competition is open to any UK registered charity who has enrolled with PayPal Giving Fund (“Eligible Charities”). Check the charity directory to see if a charity is enrolled here
If a charity is not enrolled, it can enrol for free by following these steps:
- Apply for a PayPal business account for your charity
- Confirm your charitable status
- Enrol your charity with PayPal Giving Fund
No purchase necessary for eBay users or charities to be eligible for the Prizes or Awards.
3) How to Participate:
For Eligible Participants
Eligible Participants must nominate a favourite charity (or charities) by completing the following procedure:
- Signing into www.eBay.co.uk during the Competition Period;
Designating one or more of their favourite UK charities by clicking on the “save as favourite” button located next to a charity’s name on any eBay.co.uk page, or within the eBay Android and/or iPhone App.
Alternatively, Eligible Participants can visit the eBay for Charity directory (http://charity.ebay.co.uk/ ) and designate a “favourite” charity by clicking the “save as favourite” button next to that charity’s name.
Once an Eligible Participant has successfully favourited a charity, they will receive one (1) entry in the Competition and this shall be considered an “Eligible Entry”.
Please note: An Eligible Participant is limited to one entry per eBay user ID.
If a dispute results as to the identity of an Eligible Participant, it will be determined that the entry was submitted by the authorized account holder of the eBay User ID from which the entry is made. For these purposes, the authorized account holder is the natural person assigned to an eBay User ID by eBay.
For Eligible Charities
Eligible Charities will automatically be entered into the Competition. Please note paragraph 4 below if this is not desired for any reason.
There is no fee to register to become a member of eBay, nor for a charity to enrol with PayPal Giving Fund. For more information on how to join eBay visit www.ebay.co.uk.
4) Opt-out of entry
If an Eligible Participant or an Eligible Charity does not wish to be entered into the Competition/win a Prize or Award, please send an email to email@example.com containing: a) the words "Opt-out of the Prize/Award Draw" in the subject box; b) your eBay user ID if you are an Eligible Participant or your charity name and PayPal email address if you are an Eligible Charity; and c) your request to opt out of the Prize/Award Draw, as applicable.
5) Prizes, Awards and notifications:
All prizes are subject to verification of eligibility and compliance with these Terms and Conditions.
For Eligible Entries
Five (5) winners will be selected in a random draw in mid-November 2016 from amongst the Eligible Entries. Each winner will receive £250 which will be transferred into his/her PayPal account (each a “Prize”, and each winner a “Prize Winner”).
Prize funds will be transferred to the winners’ PayPal accounts. Prize winners must have an account in good standing or must create a PayPal account at the time the Prizes are awarded, in order to receive, access and use the Prize. If you are an existing PayPal customer, your Prize will be deposited into the PayPal account associated with the email address you provided. If the email address you provided is not associated with your PayPal account, you must associate it with your PayPal account within ten (10) days from the time of winner notification. If you do not currently have a PayPal account, you must create a PayPal account within ten (10) days from the time of winner notification to qualify. You can sign up here to register for a PayPal account.
Winners must have a PayPal account in good standing at the time the Prizes are awarded. The Prizes will be credited into the winners’ respective PayPal accounts within 4-6 weeks after winner notification.
The Prize Winners will be notified by email and/or overnight or postal mail on or about 15 November 2016.
For Eligible Entries
Eligible Charities will be featured on a leaderboard located on the Competition landing page found at http://charity.ebay.co.uk/leaderboard (“the Leaderboard”). The Leaderboard will be updated regularly throughout the Competition Period, featuring the top three (3) charities based on the number of “favourite” designations.The three (3) Eligible Charities with the highest number of “favourite” designations from Eligible Participants at the end of the Competition Period will each win a cash sum (the “Award”, and each winner an “Award Winner”). In addition, a “small” Eligible Charity (i.e., such Eligible Charities with an annual turnover of under £1.5m) with the highest number of “favourite” designations from Eligible Participants at the end of the Competition Period will also win an Award (and be an “Award Winner”), provided that it did not win an Award for any other reason. Only one Award per eligible Charity permitted. In such an event, the ‘small’ Eligible Charity with the next highest number of ‘favourite’ designations, as detailed above, will that Award and so on.
The determination of the Leaderboard winners will be carried out in the presence of an independent observer (the “Adjudicator”). In the event of a tie whereby two (2) or more charities in the top three (3) have the same number of designations or more than one (1) small charity have the same number of designations, the relevant Award will be shared equally between the tied charities as determined by the Adjudicator. The Adjudicator’s decisions are final and binding on all matters relating to this Competition and no communication will be entered into. Potential reward recipients are subject to eligibility, verification and compliance with these Terms and Conditions.
“Favourite” designations made prior to the Competition Period will not be taken into account. All UK charity organisations enrolled with PayPal Giving Fund are eligible to win an Award, unless they specifically opt-out of the Competition prior to the start of the Competition Period. Each registered charity ID enrolled with PayPal Giving Fund is considered a separate charity for the purposes of determining the Leaderboard winners, however, only the most successful charity ID per registered UK charity organisation will be eligible for the Award.
The Awards are:
- (1) First Place Award of £7,000; and
- (1) Second Place Award of £3,000; and
- (1) Third Place Award of £2,000; and
- (1) Small Charity Award of £2,000.
The Awards will be made by eBay to the PayPal account the winning Eligible Charity has used to enrol with PayPal Giving Fund.
The Awards will be issued within a maximum of 6-8 weeks from the end of the Competition Period.
The winning charities will be notified by email, to the email address they have registered with PayPal Giving Fund. The names of the winning charities will be available between 15 November 2016 and 15 December 2016 on http://charity.ebay.co.uk/leaderboard.
One Prize and Award per entrant. Prizes and Awards are non-transferable and no substitutions or cash equivalents are allowed, except at the discretion of eBay who may substitute the Prize with a prize of equal or greater value
All taxes and any other costs not specifically stated within these Terms and Conditions are the sole responsibility of the winners.
6) Winners’ Details:
To find out the names of the winners, please email firstname.lastname@example.org available after 31 January 2016 with the subject line “Winner details request.”
7) Change of Contact Details:
It is your sole responsibility to keep your eBay account in good order with correct and up-to-date details in order to be awarded a Prize.
8) Exclusion from Participation:
Any attempt to manipulate the Prize Draw is prohibited and will result in exclusion from participation. In such event, eBay may void any entries they suspect are at issue and award the prize from among all non-suspect eligible entries received up to the date of cancellation.
Any entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Entries that are mechanically reproduced, copied, illegible, incomplete or inaccurate are void. Entries made through the use of any agent or other device or artifice to enter multiple times in a day will be deemed invalid. Incomplete entries not complying with these Terms and Conditions are subject to disqualification and will be deemed void.
You will not be eligible for the Competition if your accounts on any eBay site are not in good standing. In order for your accounts to be deemed in good standing your account must not be suspended or any payments are past their due date during or after the Competition Period. In addition, you will not be eligible for the Competition if your PayPal account is or becomes locked, closed or restricted during or shortly after the Competition Period.
If eBay has suspicions or knowledge that any entrant (user or charity) has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that entrant and any related entrants.
eBay reserves the right to disqualify participants who do not comply with these Terms & Conditions or with the eBay User Agreement and/or any other eBay policies.
9) Limitation of liability:
eBay makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with any Competition.
eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Competition. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.
eBay will not be responsible for any third party's performance or failure to perform any services related to any Competition, or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Competition, provided that nothing shall limit eBay's liability for death or personal injury caused by its negligence.
eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Competition.
Although eBay will use reasonable efforts to ensure that all information relating to the Competition ("Competition Material") is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Competition or the site, including without limitation the accuracy of any Competition Material.
ENTRANTS HEREBY AGREE TO RELEASE, INDEMNIFY AND HOLD HARMLESS EBAY, AND WIRE STONE, LLC, THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, DIVISIONS, ADVERTISING AND PROMOTION AGENCIES AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES AND SHAREHOLDERS (COLLECTIVELY, THE “RELEASEES”) FROM ANY CLAIMS, ACTIONS, LOSSES, LIABILITIES, COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEYS’ FEES), LOSS OR DAMAGES OF ANY KIND (COLLECTIVELY, “CLAIMS”), RESULTING FROM PARTICIPATING IN THE COMPETITION OR ANY CLAIMS ARISING FROM THE ACCEPTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY.
eBay reserves the right to suspend, change or cancel this Competition at any time, in the event of circumstances arising which in eBay's opinion make it necessary for it to do so. eBay reserves the right to add additional terms and conditions for certain parts of this Competition.
eBay’s decisions are final and binding on all matters relating to this Competition.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR ANY ONLINE SERVICE RELATED TO THE COMPETITION TO UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, EBAY RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
eBay’s failure to enforce any terms shall not constitute a waiver of such term or any other provision. eBay reserves the right to disqualify any entrant who violates the rules or interferes with the Competition in any manner. If an entrant is disqualified, eBay reserves the right to terminate such entrant’s eligibility to participate in the Competition. Any attempt by an individual or organisation to access any website associated with the Competition via a bot script or other brute force attack or any other unauthorized means will result in that individual or organisation’s IP address and all entries from that IP address becoming ineligible. Use of automated entry devices or programs is prohibited.>
By accepting a Prize or an Award, each Prize Winner and/or Award Winner consents to the use of his/her name, charity name, image, likeness, photograph, voice and biographical material and entry submission for advertising, publicity and promotional purposes by eBay, or a party designated by eBay, in any and all media now or hereafter known including but not limited to, any online announcements, or for sharing this information with the press for viewing, whether TV or print, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law.
The laws of England and Wales govern this Competition. Each party irrevocably agrees that any claim, dispute or matter arising under or in connection with these Terms and Conditions shall be governed and construed in all respects by the laws of England and Wales. You and eBay both agree to submit to the exclusive jurisdiction of the English Courts.
eBay may carry out this Competition through its local subsidiaries. eBay may use third parties to facilitate one or more elements of the Competition and we may provide some of your personal information to them. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation.
The Competition is open to all UK charities enrolled with PayPal Giving Fund. The appearance of any UK charity on the Leaderboard, or as a Leaderboard winner, does not constitute any particular recommendation or endorsement by eBay, eBay Entities, or PayPal Giving Fund (Registered charity No. 1110538) of that charity or its work.
eBay Europe S.a.r.l., 22-24 Boulevard Royal, L-2449 Luxembourg ("eBay" or "we") is the organiser of this Competition. eBay may carry out the Competition through its local subsidiaries.
Our cooperating partner Wire Stone, LLC, 35 Pinelawn Road, Suite 108W, Melville, NY 11747 (hereinafter, "Wire Stone") is responsible for the selection and notification of winners.
